Terms of Service for Patriot Pages

 

1. Membership Eligibility

1.1 General Eligibility: Patriot Pages is a membership-based organization serving conservative business owners who align with our core values and principles. By applying for membership, you affirm your commitment to these values and agree to abide by our community standards. Membership is a privilege and not a right, subject to review and approval by Patriot Pages.

1.2 Non-Discrimination Commitment: In compliance with federal and state laws, Patriot Pages does not discriminate on the basis of race, color, religion, gender, national origin, age, sexual orientation, gender, or disability in its membership decisions.

1.3 Membership Approval: Membership approval is at the discretion of Patriot Pages, based on the alignment of an applicant’s business practices and values with those of our organization. Additionally Patriot Pages business interests are a primary consideration. This process is designed to ensure a cohesive and like-minded community, committed to our shared principles.

1.4 Membership Review and Renewal: Membership is subject to periodic review and renewal. This process allows for the reassessment of a member's continued alignment with the organization's values and goals.

1.5 Right to Termination: We reserve the right to cancel any membership at our discretion. This right is exercised judiciously, in accordance with our policies, and in alignment with applicable laws. Termination decisions are based on, but not limited to, factors such as a failure to align with our core values, non-compliance with membership terms, or because termination is in the business interests of Patriot Pages.

1.6 Appeals Process: In the event of membership cancellation or denial, an appeals process is available. This process provides an avenue for review and reconsideration of membership decisions, ensuring fairness and due process. Specifically, within thirty (30) days of a termination of membership, the former member may send an email to admin@patriotpages.org detailing why the decision should be reversed. Patriot Pages commits to reviewing each appeal and will respond. The decision following the appeal is final. Patriot Pages reserves the right to provide or withhold reasoning for the appeal decision.

 

2. Use of Services for Lawful Purposes Only

2.1 Lawful Use Requirement: Members are entitled to use Patriot Pages services, including directory listings, marketing grants or credits, and discounted services, for lawful purposes only. Any misuse of the services, including activities that undermine the spirit of our conservative community or violate applicable laws, may result in suspension or termination of membership.

2.2 Member Legal Compliance Representation: By becoming a member of Patriot Pages, members attest that their business, including its practices, processes, products, or services, are in compliance with all applicable laws and regulations. Members are responsible for continually ensuring this compliance and must notify Patriot Pages at admin@patriotpages.org if there are any changes affecting their legal compliance status.

2.3 Reporting of Illegal Activities: Members and the public may report any suspected illegal activities or non-compliance by a Patriot Pages member to admin@patriotpages.org. Upon receiving such reports, Patriot Pages will conduct a review, and if the allegations are found to be accurate, may terminate the membership of the involved party.

2.4 Limitation of Liability for Member Activities: Patriot Pages is not responsible for determining the legality of its members’ business activities. The responsibility for ensuring legal compliance rests solely with the member. Patriot Pages disclaims any liability for illegal or non-compliant activities conducted by its members.

 

3. Fees and Payment Terms

3.1 Membership Fee: Membership to Patriot Pages requires a monthly fee of $19.95. This fee grants membership to Patriot Pages but is not payment towards any services or products offered by Patriot Pages.

3.2 Fee Changes: The membership fee is subject to change. Members will be notified in advance of any fee changes. Continued use of the service after a fee change indicates acceptance of the new fee amount.

3.3 Payment Collection: The membership fee will be automatically collected each month from the member’s registered payment method. This recurring payment will continue in perpetuity unless the membership is canceled by either Patriot Pages or the member.

3.4 Responsibility for Payments: Members are responsible for making timely payments. This includes maintaining a valid payment method on file. Failure to make timely payments or update payment information may result in suspension or termination of membership services.

3.5 Cancellation: Members may cancel their membership at any time, as outlined in our Cancellation Policy. Upon cancellation, automatic billing will be discontinued.

 

4. Cancellation Policy Members may cancel their membership at any time. Members simply need to send an email to admin@patriotpages.org with their request to cancel their membership. Upon cancellation, members forfeit any unused credits or benefits.

 

5. Grant and Credit Utilization

5.1 Overview of Credits and Allowances: As a benefit to continued membership Patriot Pages offers an initial $500 in credits and allowances. The term "grant" is used for marketing purposes to signify that these are benefits provided by Patriot Pages and do not constitute a separate purchase.

5.2 Member-Managed Credits: Members have the discretion to use a portion of their credits and allowances for a range of services. These may include brand development, promotional materials, marketing initiatives, AI integration/generation, or other business services offered or approved by Patriot Pages. Availability of these services or products may vary, and certain offerings may have a cap on the amount of credits that can be applied.

5.3 Patriot Pages-Managed Utilization: A portion of the credits and allowances may be utilized by Patriot Pages on behalf of the member. This includes, but is not limited to, a listing in the Patriot Pages directory and participation in joint marketing campaigns. By accepting these terms, the member authorizes Patriot Pages to use their business information logo, website, contact details, and branding in marketing efforts targeted at potential conservative customers, other businesses, or in other ventures Patriot Pages determines brings value to Patriot Page’s business interests or Patriot Page’s vision of a Patriot Economy.

5.4 Notifications of Opportunities: Patriot Pages will periodically inform members, typically via email, about new opportunities to utilize their credits and allowances.

5.5 Membership Termination and Credit Forfeiture

Upon the termination of membership, whether by the decision of Patriot Pages or by the member, all unused credits and allowances will be forfeited. These credits and allowances are non-transferable and become irredeemable immediately upon the cessation of membership. This policy applies to all forms of termination, including voluntary cancellation or termination by Patriot Pages.

5.6 Time of Utilization of Credits and Benefits

Patriot Pages does not set or guarantee specific timeframes for the utilization of member benefits, including credits and allowances. Members acknowledge that opportunities to use these benefits may vary and are subject to availability. Patriot Pages makes no commitment to provide opportunities for members to use all of their credits at once or within a specific period. The distribution and availability of such opportunities are at the sole discretion of Patriot Pages.

5.7 Disclaimer of Guarantees on Business Outcomes

Patriot Pages does not guarantee specific business outcomes, success, profit increases, or returns from the use of our services, including any marketing or business services obtained through membership. Members acknowledge that the success or failure of marketing efforts and business services is inherently unpredictable. Patriot Pages makes no representations or warranties regarding the effectiveness, impact, or success of the services provided. Members agree that their business success or failure is not dependent upon, nor the responsibility of, Patriot Pages.

5.8 Distinction Between Membership Fee and Credits

The monthly membership fee paid by members of Patriot Pages is exclusively for the purpose of maintaining membership status within the organization. This fee does not constitute payment for any benefits, credits, allowances, or services offered by Patriot Pages. The credits and allowances provided to members are benefits of membership and should not be construed as items purchased with the membership fee. Their provision is subject to the terms and policies of Patriot Pages and are offered at the discretion of the organization.

5.9 Valuation of Services and Products

The valuation of potential or offered services, products, or approved services and products available to members as part of their membership benefits is determined solely by Patriot Pages. This valuation may vary and is subject to change at any time without prior notice. Members acknowledge that the perceived or estimated value of these services and products is set by Patriot Pages and may not correspond to market or retail value.

 

6. Content Ownership and Rights All content submitted to Patriot Pages by members remains the property of the respective member. However, you grant Patriot Pages a non-exclusive, royalty-free license to use, reproduce, and distribute such content, and any other content relevant to your business in connection with our services and business.

 

7. Limitation of Liability

7.1 Comprehensive Limitation: In no event shall Patriot Pages, its affiliates, directors, officers, employees, agents, or representatives be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Patriot Pages has been advised of the possibility of such damages), arising out of or in connection with: (a) your use or the inability to use our services; (b) unauthorized access to or alteration of your transmissions or data; (c) statements or conduct of any third party on the service; or (d) any other matter relating to the service.

7.2 Disclaimer of Warranties: Patriot Pages provides its services "as is" and without any warranty or condition, express, implied, or statutory. Patriot Pages specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, reliability, or usefulness of any information, services, products, or other material provided through the service. You agree that the use of our services is at your sole risk.

7.3 Reliance on Information: You expressly understand and agree that Patriot Pages shall not be liable for any loss or damage resulting from your reliance on information or other content provided through the service, including but not limited to, information related to business practices, marketing, or financial outcomes.

7.4 Acknowledgement: By accepting these terms, you acknowledge that this limitation of liability is a fundamental element of the basis of the bargain between you and Patriot Pages and that the service would not be provided without such limitations.

 

8. Dispute Resolution by Arbitration

8.1 Agreement to Arbitrate: In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms of Service or the breach thereof, the parties hereto shall use their best efforts to settle the dispute. To this effect, they shall consult and negotiate with each other, in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If they do not reach such solution within a period of 60 days, then, upon notice by either party to the other, all disputes, claims, questions, or differences shall be finally settled by arbitration administered in the state of Florida.

8.2 Arbitration Process: The arbitration shall be conducted by a single arbitrator, jointly selected by the parties. If the parties are unable to agree on an arbitrator, the arbitrator shall be appointed in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and can be done virtually, unless otherwise agreed upon by both parties.

8.3 Location of Arbitration: The location for any in-person arbitration shall be in Florida, USA, unless otherwise mutually agreed upon by both parties. The parties agree that any arbitration shall be conducted in a manner that preserves confidentiality.

8.4 Binding Arbitration: The decision of the arbitrator shall be binding and may be entered as a judgment in any court of competent jurisdiction.

8.5 Limitations on Arbitration: The parties agree that any arbitration under this agreement shall be limited to the dispute between Patriot Pages and the individual party, and that no class arbitration, or other representative action may be undertaken by the arbitrator.

 

9. Amendments to the Terms We reserve the right to amend these terms at any time. All amendments will be posted on our website and effective immediately upon posting. Furthermore, a courtesy copy of any updated terms will be emailed to each member’s email on file with Patriot Pages. Continued use of the service after any amendment constitutes acceptance of the new terms.

 

10. Compliance with Laws Members are responsible for ensuring that their use of Patriot Pages services complies with all applicable laws and regulations. Members must also ensure that their business practices conform to legal standards.

 

11. Severability If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect the other provisions of these Terms, which shall remain in full force and effect. In such instances, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.
